LPG Partner Andrew Premisler Wins Coverage Action in the U.S. Court of Appeals, Second Circuit
On behalf of St. Paul Fire & Marine Insurance Company, LPG Partner Andrew Premisler obtained affirmance of the lower court’s dismissal of a $1,000,000 insurance coverage claim in the U.S. Court of Appeals, Second Circuit. The Court found that St. Paul properly denied coverage due to Plaintiffs’ failure to provide notice of the accident no less than three (3) months late. The Court rejected Plaintiffs’ claim that the policy’s notice provision was ambiguous and otherwise required notice only when the insured “affirmatively” committed some act that may later result in a demand for damages. Specifically, the Court found that Plaintiffs’ argument that the notice provision does not cover “nonaction” (e.g., the insured’s failure to repair a defective condition that caused the claimant’s injury) is unreasonable. The Court also rejected Plaintiffs’ claim that notice to its broker constituted notice to St. Paul as the broker was not acting as St. Paul’s agent under the “cloak of apparent authority.” The Court further found that Plaintiffs had no “good-faith belief in nonliability” in light of their knowledge of the accident, its location and the claimant’s hospitalization as well as other factors. LPG Wins Fidelity Bond Claim for Underwriters in Appellate Court
On behalf of Certain Underwriters at Lloyds, David Potter and Andrew Premisler obtained dismissal of a $5.4 million fidelity bond claim in the New York Supreme Court, Appellate Division, First Department. The fidelity bond required the insured to provide notice "[a]t the earliest practicable moment after discovery of [the] loss by the Corporate Risk Manager..." and bring any action within two years of such discovery. The First Department (in reversing the lower court) found that "plaintiffs breached their duty to ‘exercise reasonable diligence … to acquire knowledge’ of covered losses. As a result, the First Department dismissed insureds' complaint on late notice and suit limitations grounds. Click here for a copy of the decision.

LPG Obtains Declaration that Restrictive Covenant is Unenforceable
In the Southern District of New York, David Potter and Marci Goldstein Kokalas represented an individual who had signed a non-compete agreement with her former employer. The Court granted the employee’s motion for summary judgment declaring the non-compete and non-solicitation provisions unenforceable under New York law and awarding the employee severance pay. Jaipat Jain to Chair New York City Bar Committee
LPG Partner Jaipat Jain has been nominated to chair the Asian Affairs Committee of the New York City Bar. He will assume his position in the fall term. The Asian Affairs Committee is a standing committee of the City Bar. It addresses legal and policy issues and developments in Asia.

Jaipat Jain to Co-Chair New York City Bar's Climate Change Initiative Working Group
LPG Partner Jaipat Jain will co-chair the Technology Tranfer Working Group of New York City Bar's Climate Change Initiative. Jaipat will address the City Bar's Open Meeting on March 2 on technology transfer issues. The City Bar is developing a variety of legal and policy initiatives to mitigate and adapt to Climate Change. At the March 2 meeting, committee chairs will present this work and explore opportunities for conducting research and writing reports, convening lectures and public programs, and participating in the planning necessary to enable our community to survive and thrive in a changed climate. LPG Partner named President-elect of Down Syndrome Research and Treatment Foundation
June 04, 2009- The Down Syndrome Research & Treatment Foundation (DSRTF) has named LPG partner Steve Lazare its President-Elect. DSRTF is the world's largest source of private funds for Down syndrome cognition research, and is dedicated to understanding and developing a safe treatment for the deficiencies in learning, memory and speech experienced by those with DS. DSRTF has funded groundbreaking and ongoing research being conducted at Stanford University, Johns Hopkins and elsewhere. Mr. Lazare and his wife Mary have three children. The youngest, Anna (5), has DS and is the inspiration for Anna's Amigos. Mr. Lazare also co-founded the "Romp for Research," a yearly fundraising drive held in New York City and elsewhere in the United States for the benefit of DSRTF.
